Compliance Survival: COBRA, HIPAA And Privacy
The “Compliance Survival” Seminar reviews the liabilities and responsibilities of COBRA, HIPAA and Privacy laws. Emphasis is placed on the fact that these are employer laws – not insurance laws. The compliance responsibilities fall to the employers and many are not aware of those responsibilities.
The manual begins with a self-audit – how close to being in compliance are you? Then we will discuss what you might need to do to be in total compliance. The first thing an auditor wants to see is a company’s compliance procedure manual. Most employers do not have a written manual. In this manual authors will discuss the purpose of this manual and what it must include. Then it will discuss the specific laws and how they have changed over the years. HIPAA privacy involves many areas of insurance and record will discuss who can have access to medical records; how the claim filing and enrollment process will be changing; and the standards for confidentiality and security of identifiable information. This manual explains why it is dangerous for the employer to know about medical conditions of their employees – when they must know and when they can’t.
