Question : My mother died in Florida without a will.?
My mother died last year. She did not have a will. Her only asset was a bank account. My sister and brother that live in Florida got an attorney and went to probate court and filed papers listing themselves as the only heirs. The problem is that they did not list the other three heirs. I recently found out that they got the funds from the bank account and split them. What option do the other children who were not listed as heirs have? I think that they had a legal duty to list all my mothers children as heirs. But, what do we do now?

It’s a civil matter, you and the other rightful heirs will have to sue your sister and brother-in-law in small claims court if you want any share in your mother’s assets. You might want to discuss your options with an attorney to decide if it is worth doing so.
Your only recourse is a civil law suit against your two siblings. Try to reason with your brother and sister, if that doesn’t work make a decision of how much money is at stake, how much the legal fees would be, and would it be worth it. I am sorry to hear you are going through this, but a death of a close relative really brings out the worst in people sometimes.
