Question : Company forgot to charge my card and now 2 months later they want money.?
Ok heres the question. I got set up with an online merchant acount and needed 2 wireless credit card machines. they told me it would be $ 400 for the rental and a $ 600 security deposit. so the said the only why they could accept payment is using a card so i gave them my card and everything went smoth. they sent the machines and i used them for the 2 weeks and sent them back when i was done.
Well a few months went by and i never recieved my security deposit back so i started calling and getting the runaround. They where either out of the office all the time or on vacation or in new yourk for the week. this went on for another month. Finaly the last time i spoke with someone they said that they never charged my card for the $ 400 rental fee and the $ 600 deposit, which when i looked back, they didnt. but now im so upset with there service and how they treated me as a customer i wouldnt want to pay them. they asked me in a e-mail that i need to pay them. Legally do i have to pay?

You need to pay them for the agreed upon amount for the services that they rendered as long as th services were as promised.

Totally agree with PC1761. And yes, you still have to pay. Complaints about customer service and how they treated you won’t help you. You received the service, you didn’t complain at the time, making me (and the company) assume that everything went well. So why shouldn’t you pay. It’s like your boss telling you that you wouldn’t get paid for last week’s work because today you upset him. Dude, you worked that week, you deserve your pay. Same thing.

Funny, you noticed you didn’t get refunded the deposit, but didn’t notice you were never charged $ 1,000 in the first place. Did you think they wouldn’t check when you asked them for a refund? They provided you the service you contracted for so they are entitled to their fee. If you hadn’t called it to their attention in the first place you would have gotten it for free. You opened up the can of worms so don’t complain now that they want their money. Meanwhile you’ve collected interest on that $ 1,000 for these months. You got off easy. Give them their $ 400 due.

You owe them the $ 400.00 rental fee because you actually used the service. So they made a mistake, but is it really worth ruining your own credit over? Because that’s what will happen if you don’t pay, they will turn it over to collections and it will go on your credit report.
They made a mistake, but you seem to be missing the point that as it stands, it’s tantamount to stealing: you used their service without paying. If you walked out of a store with a $ 400.00 dress, wore it to a party, then came back to return it to the store and got busted, would you think that they had no right to have you arrested? It’s the same thing!
