Question : bank of america scammed me on credit card debt deal?
B of A made a verbal agreement over the phone with me that if I payed 5k then the rest of the debt would be forgiven. I did this and now they are threatening that if I dont pay an additional 6k(which I dont have) by next week they will take me to court for the total amont of 17k. I made agreements before with other creditors over the phone and had no problems. I am trying to clean up my credit mess but i have been taken advantage of. I should have got it in writing but it is now too late. Is there anything I can do??? This seems illegal for them to do such a thing. Do I have a leg to stand on in court???

I kinda doubt it since it was a verbal agreement, I had the same problem with them, I sent what they asked for, and they put it as a charge off for the whole amount,

I used to be a Collections Manager. My rule of thumb was a settlement ( what you were offered) letter stated the agreement and a time limit of 10 days. If you have not received that and it was verbal as you were started. Your only chance in court without proof is the fact that the 5K payment would have been posted to the account and you can show that as proof of the verbal agreement. (slim but the only chance you have)

I got scammed on a mortgage deal. One thing to know is the bank phone calls are recorded. See if you can find the name of a senior exec for BofA, prehaps a letter received from them? Email them or write them.
Also try the Federal Trade Commission http://www.ftc.gov
or Consumer Protection http://www.ftc.gov/ftc/consumer.htm
They may be able to advise.Go to the library and look up Reducing Debt in Consumer Reports. They had stuff on this within the last 5 months.

Unfortunately there is a truism that fits here: a verbal agreement isn’t worth the paper it’s written on. Unless you taped that conversation it’s down to your word against theirs. Did you at least get the name of the person with whom you made the agreement? If you did, then just maybe you could try writing a letter to B of A detailing the terms of that agreement, citing the date and time it occurred and the name of the person involved. If you don’t even have a name, then there’s not really a lot of recourse for you except to keep writing them letters in the hope that someone somewhere may relent. Good luck.

B of A (and Wells Fargo) are known for making agreements like this.
They make you agree to pay the debt by offering attractive terms, then they have no knowledge of their part of the agreement.
Because they make it so easy, the customer doesn’t think to have it put in writing.
Unfortunately, they will now take you to court, but it will be a long process to get it started.
