Question : Senior citizens have you found that long term care faciities can choose?
Who they will let in? My SO thinks they will not allow his Dad into a facility as he “Only” has SS income. My Mom has SS, a pension and Long Term Care insurance, and the facilities would prefer residents with greater income. Isn’t that illegal?

Probably varies from state to state. Different laws by state. You should be able to find out at any Senior Center.

Its not illegal. No facility is required to have Mediaid beds. Some only take private pay.These are all private businesses and of course want to make a profit. Most of those who have Medicaid beds save them for their current residents to use once they run out of private pay funds. There are always some places that will take people in on Medicaid but they are usually not the places that anyone would want to be in. Medicaid doesnt pay enough to cover the costs of a nice facility.

There are some federal laws and some national certifications that apply to long term care facilities; but these facilities are mostly regulated by the States. One of the things this means is that the answers to your questions will depend on where you all live.
There is nothing illegal about any facility considering ability to pay for its services. Your mom would likely have more choices and will likely avoid waiting lists because her long term care policy will probably pay for her care. Your boyfriend’s father would likely have fewer choices, and may have to be on a waiting list if he needs long term care beyond the 60 day rehabilitation limits on most medicare benefits. Social workers who specialize in medical care or care for senior citizens (also called Medical Case Managers, or Case Managers) are the best source of information about eligibility for programs that can assist people in finding the care they need. In the area where I live, most long term care facilities will care for people who have limited ability to pay; and will accept the lower medicaid payments, but they limit the number of ‘beds’ available to people who rely on medicaid or who are unable to pay at all.
To be honest; most people do not end up in long term care facilities. Many services can now be done at home, so most people live at home with supportive services.

They would probably take him (although I know of no law that would bar them from refusing him), bill hime privately, force him to sell everything he owns, then have him go on welfare when he can no longer pay his bills.
They can – and do – take people to cllections.
If he has Medicare, and they can think of an excuse to call his stay “rehabilitation”, Medicare would pay for 60 days.
They are almost all privately owned, and can pretty much do as they wish.

For the most part, these places are private businesses. It’s just like renting an apartment or a house. They can let in or keep out whomever they choose. They must make sure that their residents can afford the monthly fees. If they let everyone in no matter what their income, they would find themselves having to evict sick, elderly people for failure to pay. That would be absolutely horrible.

SS, pension and LTC insurance will get her into a fairly decent facility but you will need to shop around carefully. Here are some suggestions worthy of research:
